By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (Terms of Service, Terms), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service.

CUEVOLUTION.COM (We, Us or Our) reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

REGISTRATION OF SERVICE

If you would like to submit an order to the Website to purchase one of the product(s) listed on the Website, you will need to register for an account on the Website (an “Account”) which you will be able to access on the Website through the “My User Account” part of the Website.

You must keep the password confidential and immediately notify us if any unauthorised third party becomes aware of that password or if there is any unauthorised use of your email address or your Account or any breach of security known to you. Please note that you are entirely responsible if you do not maintain the confidentiality of your password.

You must be registered with a valid personal email address that you access regularly, so that, among other things, administration emails can be sent to you. Any Accounts which have been registered with someone else’s email address or with temporary email addresses may be closed without notice. We may require you to validate Accounts at registration or if we believe you have been using an invalid email address.

We reserve the right to close your Account, if you are found to have any intentions or actions that disrupts the Website in any way.

Although we save the information relating to any order that you submit to the Website to purchase one of the product(s) listed on the Website, you will be unable to directly retrieve this information for security reasons. You may access this information by logging in to your Account.

You will be able to view information relating to your completed, open or recently dispatched orders and manage and save your address information, any bank details and any newsletter to which you may have subscribed.

ONLINE STORE ORDER TERMS

We utilize a comprehensive inventory management system to ensure that the availability og our merchandise is accurately reflected on our Website. We will not be held responsible to provide any product(s) that is out of stock or no longer available at the time of purchase.

If there are any issues with your order (e.g. out-of-stock) we will contact you immediately. If no response is obtained within 48 hours, we will process the rest of your order accordingly.

You shall be responsible for ensuring the accuracy of your order.

We reserve the right to limit or refuse any order. We will contact you via email. 

PRODUCTS OR SERVICES

Certain product(s) or services may be available exclusively online through the website. These product(s) or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our product(s) that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our product(s) or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product(s) or services that we offer.

All descriptions of product(s) or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product(s) at any time. Any offer for any product(s) or service made on this site is void where prohibited.

We do not warrant that the quality of any product(s), services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

We reserve the right to modify the prices for our product(s) without prior notice.

ORDER TERMS & DELIVERY

We aim to deliver the product(s) to you at the place of delivery requested by you in your Order.

We aim to deliver within the time indicated by us at the time of your Order (and updated in the Confirmation of Order) but we cannot promise an exact date when you submit your Order or at the Confirmation of Order.

We shall aim to let you know if we expect that we are unable to meet our estimated delivery date, but we shall not be liable to you for any losses, liabilities, costs, damages, charges or expenses arising out of late delivery.

On delivery of the product(s), you may be required to sign for delivery. You agree to inspect the product(s) for any obvious faults, defects or damage before you sign for delivery. You need to keep receipt of the delivered product(s) in case of future discussions with us about it.

Please note that it might not be possible for us to deliver to some locations. If this is the case, we will inform you using the contact details that you provide to us when you make your Order and arrange for cancellation of the Order or delivery to an alternative delivery address.

You shall ensure that you are ready for safe receipt of the product(s) without undue delay and at any time reasonably specified by us.

You must take care when opening the product(s) so as not to damage it, particularly when using any sharp instruments.

If you are not available to take delivery or collection, the couriers company may leave a card giving you instructions on either re-delivery or collection from the carrier.

If delivery or collection is delayed through your unreasonable refusal to accept delivery or if you do not (within two weeks of our first attempt to deliver the product(s) to you) accept delivery or collect the product(s) from the carrier, then we may do either or both of the following:

  1. no longer make the product(s) available for delivery or collection and notify you that we are immediately cancelling the order.
  2. a) charge you for our reasonable storage fee and other costs reasonably incurred by us.

RETURNS POLICY

All items must be returned in their original condition with all tags attached. Only returns via courier service is accepted.  Sale item(s) should be returned within 7 days of receiving returns number.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel orders placed on our Website.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

CANCELLATION OF ORDER(S)

We reserve the right to cancel an order if the product(s) is not available for any reason. We will notify you if this is the case and return any payment that you have made.

The refund will be processed using the same method originally used by you to pay for the product(s).

If you wish to cancel your order please contact our Customer Service Team via email. No cancellation fees apply. Once an order has been dispatched it may not be cancelled and the item must instead be returned to the company according to guidelines provided by the customer care department (Please contact customercare@cuevolution.com or refer to your return-slip provided in your received parcel).

Preorder item(s) are not eligible for cancellations and full refunds. An exchange of equal sum/value of the item(s) purchased will be applied instead.

FAULTY ITEM(S)

Product(s) are inspected before leaving our studio and shipped to you.

If the product(s) is faulty, you agree to keep the product(s) in its current condition available for us to inspect within a reasonable time.

In order to provide you with any solutions for faulty product(s), we may need your assistance and prompt provision of information regarding the product(s).

You are required to provide us any detail we may reasonably require and specify with reasonable detail the way in which it is alleged that the product(s) is damaged or defective.

We will not replace/refund the product(s) to you if we find that the product(s) has been used and damaged due to neglect, normal wear and tear and carelessness.

PROMOTIONS & GIFT VOUCHERS

You may use promotional vouchers and gift vouchers as payment for product(s) on the Website. We may email promotional/gift vouchers to you.  We accept no liability for errors in the email address of the voucher recipient.

You may also purchase gift vouchers for use on the Site by you or other Customers. These gift vouchers will be sent by email. We assume no liability for the loss, theft or illegibility of gift or promotional vouchers.

Promotional/gift vouchers are valid for the specified period stated on them only, can only be redeemed once and cannot be used in conjunction with other promotional vouchers. Individual brands may be excluded from voucher promotions.

If you place an Order for a product(s) less than the value of the promotional/gift voucher, no refund or residual credit will be returned to you.

The credit of a promotional/gift voucher does not accrue interest nor does it have a cash value. If the credit of a promotional/gift voucher is insufficient for the Order you wish to make, you will pay the difference of the balance owed.

Gift vouchers cannot be used to buy further gift vouchers. Gift vouchers may only be purchased through debit and credit card.

An order for a gift voucher can be cancelled by contacting us via email at any time before the gift voucher has been redeemed. A voucher is considered to have been redeemed if it is used as payment in placing an Order.

You may use as many gift vouchers as you wish in paying for an Order, and gift vouchers may be used in conjunction with one promotional voucher per Order.

PERSONAL INFORMATION & PRIVACY POLICY

Your submission of personal information through the store is governed by our Privacy Policy. We will treat all your personal details as confidential.

When you register on this Website, or make a purchase we will ask you to input and will collect personal details from you such as your name, e-mail address, billing address, telephone number. We may also collect, and our third party providers may collect, information about where you are on the internet (e.g. the URL you came from, IP address, domain types such as the following:- .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, any advertisements you may have clicked on, and any search terms that you entered on our Website.

We confirm that any personal details which you provide to us and any user information, from which we can identify you, will be used only for the following purposes:

  1. maintaining your registration
  2. for statistical purposes to improve this Website and its services to you
  3. to serve Website content to you
  4. to administer this Website
  5. to notify you of products or special offers that may be of interest to you
  6. to send you information by post or email

We will not release your personal details to any third parties or company outside of CUEVOLUTION SDN BHD. If you wish to unsubscribe from receiving promotional emails, please click on the ‘Unsubscribe’ Button at the bottom of the email or send an email to customercare@cuevolution.com inserting ‘Unsubscribe’ as the subject. Please ensure that you also include the email address that you wish to be unsubscribed (if it is not the email address that you send the email from), your full name and your full postal address.

We reserve the right to modify and change the Privacy Statement at any time.

TRADEMARKS AND INTELLECTUAL PROPERTY RIGHTS

The CUEVOLUTION names and logos and all related names, design marks and slogans are the trademarks or service marks of us or our vendors. All attributes of the website including photography, written material & contents, campaigns, lookbooks, designs and logos and any other material are copyrighted to us. Use of any of our material without our consent is strictly prohibited.
